Can a creditor sue me if I owe a debt? Yes. In fact, it is quite common for creditors to file lawsuits to collect debts. In New Jersey, the lenders usually file their lawsuit in the county where you live.
New Jersey has a statute of limitations of six years on all types of loans, including those from written contracts and credit cards. If a consumer's debt is more than six years overdue, the lender can no longer act in order to collect the debt. There is no debtor's prison here in New Jersey (or anywhere in the United States) where you end up if you do not pay a bill. Collection is a civil, not criminal, matter and people that end up in debt do not end up behind bars.
A judgment lien is automatically created in New Jersey when the judgment is obtained in Superior Court. Judgment liens will be associated with the debtor's property for a total of 20 years, regardless of whether ownership of that property changes.
